On May 1, 2007, the United States Sentencing Commission submitted an amendment to the federal sentencing guidelines that would reduce penalties for crack cocaine offenses by approximately 16 months. That amendment took effect on November 1, 2007. Because this amendment lowers penalties, the Commission may, in its discretion under 18 USC 3582(c)(2), make the amendment retroactive so that it applies to defendants sentenced before November 1, 2007. The Commission is considering the issue of retroactivity and will be holding a hearing on November 13, 2007. In this article, Past President Edwards comments on the amendment.
